Terms of Service for App Sprint ASO
Effective Date: March 15, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Tap & Swipe ("we", "us", "our") regarding your use of App Sprint ASO ("App"). By purchasing, downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
App Sprint ASO is a macOS desktop application that provides:
- Keyword research and difficulty/popularity analysis for Apple App Store
- App Store metadata editing via App Store Connect integration
- Apple Search Ads campaign management and optimization
- Competitor tracking and market analysis
The App relies on Apple's publicly available and authenticated APIs. Features may vary depending on your App Store Connect access and Apple Search Ads account status.
3. Eligibility
You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account & License
4.1 License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on a single computer you own or control, solely for your personal or internal business use.
4.2 Device Binding
Your license key is bound to a single computer upon first activation using a machine identifier. You may not use the same license on multiple computers simultaneously. If you need to transfer your license to a new computer, contact us and an administrator can reset your device binding.
4.3 Restrictions
You agree NOT to:
- Use the App on more than one computer per license
- Share, resell, sublicense, or transfer your license key to another person
- Modify, reverse engineer, decompile, or disassemble the App
- Redistribute or make the App available to third parties
- Use the App to build a competing product or service
- Circumvent or attempt to circumvent the licensing or device-binding mechanisms
- Use the App for any illegal or unauthorized purpose
5. Payment
5.1 Pricing
The App is available via recurring subscription. The following plans are offered:
- Solo: 9€/month or 90€/year — limited to 1 app
- Pro: 19€/month or 190€/year — unlimited apps
All payments are processed through Stripe.
5.2 Billing
Payment is charged on a recurring basis (monthly or yearly depending on your chosen plan). Your subscription automatically renews at the end of each billing period unless cancelled. You may cancel at any time from your Stripe billing portal.
5.3 Community Membership
ASO Pro is included at no additional cost with an active App Sprint Community membership (137€/month). If your Community membership is cancelled, your ASO Pro license will be deactivated.
5.4 Price Changes
We reserve the right to change pricing at any time. Price changes do not affect your current billing period. We will provide at least 30 days' notice of any price increase.
6. Free Trial & Refund Policy
6.1 Free Trial
All new subscriptions include a 7-day free trial. During the trial, you have full access to the App's features at no charge. Your payment method is collected at sign-up but will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.
6.2 Refunds
Because a free trial is provided, no refunds are issued after the trial period ends and billing begins. By continuing your subscription past the trial, you confirm that the App meets your expectations.
For EU consumers, the free trial satisfies the right of withdrawal under the Consumer Rights Directive (2011/83/EU). By using the App during the trial period, you acknowledge that you have had the opportunity to evaluate the digital content before any payment is taken.
7. Cancellation & License Validity
Your license is valid for the duration of your active subscription. When your subscription is cancelled or expires:
- Your license key will be deactivated
- You will lose access to the App's features
- Data stored locally on your device remains yours and is not deleted
You may reactivate your license by resubscribing at any time.
8. Prohibited Use
In addition to the restrictions in Section 4.3, you may not:
- Use automated tools to abuse or overload the App's API connections
- Attempt to access other users' license keys or data
- Use the App in any way that violates Apple's terms of service
- Misrepresent your identity or affiliation when using the App
9. Intellectual Property
9.1 Ownership
The App, including all code, design, features, and documentation, is owned by Tap & Swipe and is protected by copyright and other intellectual property laws.
9.2 Your Data
You retain full ownership of all data you create or store within the App, including your keywords, projects, and metadata. Your App Store Connect credentials and Apple Ads API keys are stored locally on your device and are never transmitted to our servers.
10. Third-Party Data & Apple Disclaimer
10.1 Data Accuracy
App Store data, keyword metrics, and search results are provided "as is" based on Apple's public and authenticated APIs. We do not guarantee the accuracy, completeness, or timeliness of any data.
10.2 Apple Disclaimer
App Sprint ASO is not affiliated with, endorsed by, or sponsored by Apple Inc. "Apple", "App Store", "App Store Connect", and "Apple Search Ads" are trademarks of Apple Inc. Use of Apple's APIs is subject to Apple's own terms and conditions.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW (SUBJECT TO MANDATORY CONSUMER PROTECTION LAWS FOR EU CONSUMERS), THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy or completeness of App Store data or keyword metrics
- Warranties that the App will be uninterrupted, secure, or error-free
EU Consumer Notice: If you are an EU consumer, this disclaimer does not affect your statutory rights under applicable consumer protection laws, including rights to conformity of digital content and services under Directive (EU) 2019/770.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (SUBJECT TO MANDATORY PROVISIONS FOR EU CONSUMERS):
12.1 EU Consumer Notice
For EU Consumers: Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under applicable consumer protection laws
12.2 Maximum Liability
Subject to Section 12.1, our total liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
12.3 Exclusion of Damages
Subject to Section 12.1, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.
13. Termination
We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:
- All licenses granted to you will immediately terminate
- You must cease all use of the App
- Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability
14. Governing Law
These Terms are governed by the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
EU Consumer Notice: If you are an EU consumer, you may also bring proceedings in the courts of the EU member state in which you reside. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of the law of the country in which you live.
15. Changes to Terms
We may revise these Terms from time to time. We will provide at least 30 days' notice of material changes via email or through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
